You should only use Acorn Property Group’s website, complete an online ‘Download Brochure’, ‘Request a call back’ or ‘Register your interest form’ and complete a Reservation Form if you agree to the use of your personal information in accordance with these policies.

2.1 We are Acorn Property Group, our head office is located at 1 Frederick Place, London N8 8AF. We operate the Website and we are the data controller for the purposes of the Act and the Regulation.

2.2 We are registered with the ICO to process your personal data and our registration number is ZA837217.

2.3 Your data will be processed by RST London Limited trading as Acorn Property Group, a company registered in the United Kingdom with its registered office Kemp House, 152 – 160 City Road, London, EC1V 2NX. RST London LTD trading as Acorn Property Group host our Website and will be the data processor for the purposes of the Act and the Regulation.

3.1 By completing online forms, a reservation form and/or otherwise using the Website, you expressly consent to:

3.1.1 provide Acorn Property Group with the personal data necessary to allow you to use the Website;

3.1.2 the processing of your personal data by Acorn Property Group or those specifically listed third parties, in accordance with this policy; and

3.1.3 the transfer of your personal data to those third parties listed in this policy, for the reasons specified.

3.2 You may withdraw your consent under 3.1 at any time. However, where this withdrawal prevents us from communicating with you, we may not be able to provide our goods and services to you.

5.2.2 visit-specific information – your URLs, Projects and Properties you viewed or searched for, your clickstream through the Website.

7.2.1 opportunities to invest in our Developments through Acorn Property Invest, Developments or Properties listed on our Website that are similar to those you have already viewed or enquired about; or

7.2.2 changes to our Website or our services.

7.3 We use any data we collect about you (as a result of your visit to our Website) to:

7.3.1 personalise and improve our services (including the Website and its security);

7.3.2 deal with your enquiries and requests;

7.3.3 administer and monitor traffic and behaviours on our Website for analysis, testing, research, statistical and survey purposes;

7.3.4 ensure that any part of our Website (including any Content) is presented in the most effective manner for you and your computer or device, and to make improvements (where necessary); and

7.3.5 keep our Website safe and secure.

7.5 We will only keep your data for as long as it’s necessary. This time varies and is dependent upon its purpose or if you enter into a contract with us.

7.5.1 Property purchase – Each of our properties come with a 10-year structural warranty typically from BuildZone. Therefore, we will keep your records (name, address, contact details, certificates, purchase and sales contract information) for up to 12 years from the date of completion.

7.5.2 Anti-money laundering – If you directly provide us with personal information so that we can satisfy anti-money laundering obligations we will be legally required to retain this information for a period of 5 years.

7.5.3 If you request sales and marketing information – the information you provide when requesting sales and marketing information about our developments will be kept for up to 5 years (unless you unsubscribe or request we delete it) as some developments can take a number of years to plan, market and complete.

We may need to keep your data for longer if we are unable to delete it for legal and/or regulatory reasons.

  1. HOW AND WHY WE DISCLOSE YOUR DATA 

8.1 We will only use your personal information to provide you with details of our own properties or developments which we believe will be of interest to you. Sometimes we need to share personal information we hold about you with other organisations that we work with or who provide services on our behalf. Where sharing is in our legitimate business interests, we may share your information without seeking your consent first.

When sharing information, we will comply with all aspects of data protection law. Subject to the rest of part 8 of this policy, Acorn Property Group will only disclose your personal data to the following third parties for the following purposes:

8.1.1 Estate agents partnering with us on specific developments – in connection with your interest in a development or a reservation in progress

8.1.2 Solicitors – in connection with your reservation

8.1.3 Our approved third-party data processors – such as our approved CRM system providers and email transaction provider

9.1 We may contact you for the following reasons:

9.1.1 For legitimate purposes aligned with our contract

Where it is necessary for our legitimate interests (or those of a third-party eg estate agents or solicitors) and your interests and fundamental rights do not override those interests

9.1.2 In relation to a previous communication from you. This includes any comment or complaint concerning us, our services, properties or developments, or any previous contact we may have had with you

9.1.3 If you requested further information or signed up for a product, property or development, whether directly through us or via a third-party provider, such as a property portal

9.1.4 If you have expressed an interest in a specific product, property or development

9.1.5 To provide you with additional information concerning a specific property/development, type of property/ development or similar properties/developments to those in which you have expressed an interest

9.1.6 For marketing purposes, if you have chosen to receive a service from us by completing one of our website forms and not opted out

9.2 We will only contact you for marketing purposes, via email or phone, if you have agreed to this or where you have requested a service from us and not opted out at a later date.  You can easily unsubscribe from any of those sources at any time by clicking the unsubscribe button on the bottom of our marketing emails or by emailing us at info@acornpg.org.

We will deem a service request to be any of the following:

9.2.1 Register your interest – when you enquire about a ‘live’, ‘coming soon’ or ‘future’ site

9.2.2 Request a callback – when you request us to call you back to find out more about one of our developments

9.2.3 Download Brochure – when you complete a form to download a brochure

10.1 We have put in place appropriate technical and organisational measures to help protect your personal information from unauthorised access, use, disclosure, alteration or destruction consistent with applicable Data Protection Laws.

10.2 Staff have access to personal data only for the purposes of performing their roles.

10.3 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

11.1 In relation to all of your personal data, you have the following rights to ask Acorn Property Group (in addition to any rights you may have under the Act or the Regulation):

11.1.2 to clarify what data Acorn Property Group hold about you, how it was obtained, to whom it has been disclosed and for how long it will be stored;

11.1.3 to amend any inaccurate data Acorn Property Group hold about you;

11.1.4 to delete any of your data (where you no longer think Acorn Property Group need to hold it or you think we have obtained it or processed it without your consent at any time); and

11.1.5 to only process your personal data in limited circumstances or for limited purposes.

11.2 If you wish to exercise any of your rights at any time, please contact us on the details contained at the beginning of this policy in the first instance. We will require you to verify your identity to us before we provide any personal data, and reserve the right to ask you to specify the types of personal data to which your request relates.

11.3 Any data provided to you in accordance with your rights will be in a structured and machine-readable form.

12.1 Some of our developments and Sales Offices use CCTV to make sure we provide a safe and secure environment for all visitors to our premises and to ensure the protection of our employees and property.
